FDA Sends 25 More Warning Letters Over Compounded GLP-1 Marketing Claims

The June letters continue a pattern running back to September 2025, and the target is consistent: what providers say their product is.

The action

On 16 June 2026 the FDA issued 25 warning letters to telehealth companies, alleging their websites carried false or misleading claims about compounded semaglutide and tirzepatide products, and in one case liraglutide.

The letters continue a sustained sequence. More than 55 went to online sellers in September 2025. More than 40 followed to telehealth-based compounding pharmacies in late 2025. Thirty more were issued in early 2026, carrying an explicit threat of legal action without further notice.

What the agency is actually objecting to

Not manufacturing, in most of these letters. Marketing.

The recurring allegation is that providers implied compounded GLP-1 products were equivalent to their FDA-approved counterparts. That claim is false in a specific legal sense: an approved product has been through premarket review of safety, effectiveness and manufacturing quality, a generic has demonstrated bioequivalence and been approved on that basis, and a compounded preparation has done neither.

There is no generic tirzepatide or semaglutide. A compounded preparation is not therapeutically equivalent as a matter of law and cannot be substituted for the brand. "Same as Wegovy" is not enthusiasm; it is a claim about regulatory status that is not true.

Why enforcement targets claims rather than product

Manufacturing failures are serious and comparatively infrequent. Marketing claims are pervasive, cost nothing to make, and directly damage the reader's ability to weigh a decision. A patient who believes they are buying an approved product has been deprived of the information that would have shaped their choice.

Commissioner Makary characterised the posture directly, describing close attention to misleading claims across media platforms and swift action, while acknowledging that compounding has legitimate roles in shortages and for individual patient needs — the objection being to compounding that circumvents the approval process.

The claim that triggered the escalation

One episode is widely cited as the turning point: an attempt by a large telehealth platform to market a compounded version of the Wegovy pill. The company withdrew in the face of legal threats. The episode appears to have sharpened the agency's focus on platforms rather than only on compounders.

The five phrases that draw letters

• "FDA-approved" applied to a compounded medication or a compounding pharmacy. No such category exists.
• "Generic Zepbound" or "generic Wegovy". Neither exists.
• "Same as" or "identical to" an approved product.
• Trial results — SURMOUNT, STEP, SELECT — quoted for a compounded preparation.
• "FDA-registered" presented as approval. Registration means the agency received required information and explicitly does not establish CGMP compliance.

What this means for choosing a provider

A provider's language is evidence about its compliance posture, and it is evidence a patient can assess without any technical knowledge. A company describing a compounded preparation accurately — not approved, not a generic, not covered by the trials — is telling you it has read the same letters.
